ENTIRE AGREEMENT
This is the entire agreement between you ("You") and the ("RH"). The effective date of this Agreement is when You accept this Agreement in accordance with the procedure set out above.
APPLICABLE LAWS
You acknowledge that specific federal and provincial statutes such as: Highway Traffic Act, R.S.O. 1990, c. H.8 as amended, Commuter Services Act, R.S.O. 1990, c. C.23 as amended, Public Vehicles Act, R.S.O. 1990, c. P.54 as amended and Insurance Act, R.S.O. 1990, c. I.8 as amended contain legal obligations concerning carpooling. You acknowledge that it is Your responsibility to become familiar with the legalities of participating in a carpool. Specifically, You acknowledge that it is Your responsibility to contact Your vehicle insurer and verify that You have sufficient insurance coverage to protect Yourself and Your carpool passengers.
FREE OF CHARGE
RH is providing this carpool matching service free of charge. Any agreement made between You and fellow carpoolers regarding cost sharing does not involve RH.
PERSONAL INFORMATION
You consent to RH's collection, use and disclosure of Your email address and full name. Your full name and email address will not be disclosed to the general membership. YOU MAY ACCESS, CORRECT AND DELETE YOUR OWN PERSONAL INFORMATION STORED BY RH BY USING THE WEBSITE OR BY EMAILING THE ADMINISTRATOR THROUGH THE "CONTACT US" PAGE.
DISCLAIMER
You acknowledge and agree that RH does not conduct, is in no way responsible for, and does not provide any warranty (express or implied) and/or guarantee of any kind with respect to, any background checks, including without limitation, any Criminal Record/Reference Checks, on the users of this Website. You acknowledge and agree that it is Your responsibility to contact, interview, research and select the carpool co-participants who are most appropriate for Your needs. You acknowledge and agree that none of the carpool co-participants are in any way acting as employees, officers, directors, agents, joint venturers or are acting in any other kind of similar relationship with RH or Regional Municipality of York, City of Toronto, Regional Municipality of Durham, Regional Municipality of Peel, City of Mississauga, Regional Municipality of Halton, City of Hamilton, Smart Commute of North Toronto, Vaughan and its members and partners, York University, its officers, Board of Governers, agents, and/or employees, and application service provider Pathway Intelligence Inc. ("Partners") while conducting carpool services. You acknowledge and agree that You will be using the information provided in this Website at your own risk and that RH and its Partners are in no way responsible, and provide no warranty (express or implied) and/or guaranty of any kind with respect to, the information provided herein.
WAIVER AND INDEMNITY
In consideration of Your becoming a member with this Website, You acknowledge and agree to waive any and all rights to, or claims for, damages (including special and consequential damages), costs, expenses, proprietary or personal injury (including death), or any other compensation of any kind whatsoever against RH and its Partners, including their respective officials, officers, directors, employees, insurers and agents that arise directly or indirectly with respect to your use and/or reliance on the information provided in this Website, Your membership with this Website and/or Your use of the carpool services and agree to indemnify and hold harmless RH and its Partners, including their respective officials, officers, directors, employees, insurers and agents for same.
Without limiting any of the foregoing, you acknowledge and agree that if You are dissatisfied with the carpool matching service or the information provided on this Website, Your sole and exclusive remedy with respect to RH and its Partners, including their respective officials, officers, directors, employees, insurers and agents, is to discontinue Your use of the website.
MODIFICATION
RH reserves the right to modify this Agreement at anytime, without prior notice and such modification shall be effective immediately upon posting on the Website. It is Your responsibility to review this Agreement periodically and make Yourself aware of any modifications. Your continued use of this Site will be deemed to be Your conclusive acceptance of the modified Agreement.
